SEC urges ETFs to update filings, hinting at possible Jan. 11 launch; decisions on key ETF applications like Ark Invest due soon

The U.S. Securities and Exchange Commission (SEC) has instructed ETF participants to update their filings quickly, Bloomberg reported on Jan. 5. This request specifically concerns 19b-4 filings, which are necessary for listing and trading ETFs on exchanges like Nasdaq and NYSE.

Some of these filings, after recent amendments, might not need further feedback from the SEC, though it's not clear if this applies to new or previously submitted versions.

In addition to 19b-4 filings, S-1 filings, which describe the ETFs, are also awaiting the SEC's approval. These were amended up to a Dec. 29 deadline. Bloomberg ETF analyst Eric Balchunas mentioned that final S-1s are due on Monday, hinting at a possible Jan. 11 launch for these ETFs.

SEC commissioners are expected to vote on exchange rules next week, potentially leading to a quick launch of ETFs, possibly one day after the vote. The SEC must also decide on an application from Ark Invest and 21 Shares by Jan. 10, which could influence other applications.
