Prosecutors Recommend Reduced Sentence for Bitfinex Hacker
US prosecutors recommend a five-year sentence for Bitfinex hacker Ilya Lichtenstein due to his cooperation, while his wife Heather Morgan receives 18 months.
US prosecutors have recommended a reduced sentence of five years for Ilya Lichtenstein, the hacker behind the 2016 Bitfinex hack, in recognition of his cooperation with authorities. Although his crimes were severe and typically would have resulted in a longer sentence, his willingness to help investigators led to this more lenient recommendation.
Lichtenstein's wife, Heather “Razzlekhan” Morgan, who played a lesser role in the crime, was given an 18-month sentence. Her involvement, while notable, was not seen as significant as her husband's.
Prosecutors filed a sentencing memorandum on October 15 for both Lichtenstein and Morgan, following their guilty pleas. The sentencing marks a significant milestone in the case, as efforts to compensate victims of the hack continue. The prosecutors emphasized the importance of sending a strong message to deter future crypto crimes, arguing that criminal activity in online spaces can sometimes be seen as trivial, despite the real harm caused to victims.
Despite their initial intention to pursue a harsher sentence, prosecutors acknowledged that Lichtenstein provided valuable information to law enforcement, including details about the hack and other illicit operations, such as Bitcoin mixers and money laundering networks that allowed him to evade capture for years. This cooperation earned him the reduced sentence, despite the initial plan to seek a prison term of 10 to 12 years.
Morgan, who gained notoriety for her public persona, was deemed to have committed less serious offenses, which factored into her lighter sentence. Still, prosecutors expressed concerns about Lichtenstein's rehabilitation and the sophisticated nature of the hack, which involved breaching Bitfinex’s security systems and eluding authorities for an extended period.
The sentencing memorandum also highlighted Lichtenstein’s abuse of Adderall, noting the importance of his continued treatment. In addition, the agreement ensures that both Lichtenstein and Morgan renounce any claims to the stolen assets, many of which have already been recovered by authorities, to facilitate the restitution process for the victims.
