CoinPaprika.com Terms of Use

1. Definitions

   1. CoinPaprika – a website available for internet users at www.coinpaprika.com, through which they can get access to electronic Services of the Service Provider (including web page coinpaprika.com, hereinafter referred to as "Website" and all materials including data, reports, text, images, messaging channels, message services, updates, content, newsletters, price alerts, merchandise, databases, forums, articles, guides and other information made available by or on behalf of CoinPaprika presented on the Website or available through it, hereinafter referred to as "Content").

   2. Plan - scope of Services defined in document "Plans and Prices" available here: https://coinpaprika.com/my-account/premium/.

   3. Service - a digital service provided by the Service Provider consisting in access to the Content andother functionalities of Coipaprikaas well as the service of newsletter submission.

   4. Service Provider - CoinPaprika sp. z o.o., ul. Piekary 12/13, 61-823 Poznań, entered into the Register of Entrepreneurs under National Court Register number 0000512326 whose files are kept by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Economic Department of the National Court Register, that uses tax identification number (NIP): 7792422423 and REGON statistical number: 302744400. Email address of the Service Provider: contact@coinpaprika.com.

   5. Terms of Use - this document that specifies the terms of use of CoinPaprika as well as the rights and obligations of the Service Provider and the User.

   6. User - any and all users of CoinPaprika.

2. Type and scope and access to the Service

   1. The Service Provider makes it possible for Users to use CoinPaprika exclusively within the following Services:
      1. Access to the Content of CoinPaprika,
      2. Contact form,
      3. Newsletter submission.
   2. The Services are free of charge only within "Free Plan"
   3. Access to some Services within “Free Plan” may require signing in the CoinPaprika.
   4. Access to Services within Plans other than Free requires:
      1. Signing in the CoinPaprika,
      2. Payment of subscription fee,
      3. Consent to the commencement of the provision of Services (access to digital services) before the expiry of the 14-day withdrawal period.
   5. To sign in the CoinPaprika you must create a User’s account by signing up.

3. Technical requirements essential for the use of Services

   1. In order to use the Service you must meet the following technical requirements:
      1. internet access,
      2. access to devices that enable internet use,
      3. access to a web browser (Chrome), in its newest version on the day provision of Services commences, that enables viewing of hypertext documents connected via the internet and supports JavaScript programming language as well as accepts cookies.

4. Forbidden actions and threats related to the use of CoinPaprika

   1. The User agrees that he or she will not:
      1. put any illegal content on CoinPaprika, especially in contact forms, in particular content that promotes racial, ethnic and religious hate, pornographic content, content that promotes fascism, Nazism, communism or violence, content that offends religious feelings, violates other people’s right as well as materials that in any way violate copyrights or trademark protection rights,
      2. copy, modify or create derivative works of CoinPaprika or any Content;
      3. copy, manipulate or aggregate any Content (including data) for the purpose of making it available to any third party,
      4. trade, sell, rent, loan, lease or license any Content or access to CoinPaprika, whether commercially or free of charge,
      5. use or introduce to CoinPaprika any data mining, crawling, ‘scraping’, robot or similar automated, data gathering or extraction method, or manually access, acquire, monitor or copy any portion of CoinPaprika, or download and store the Content,
      6. make excessive requests for information or take any action that interferes with, disrupts or imposes an undue burden on CoinPaprika or any server or network connected to CoinPaprika or negatively affects the quality or availability of any Content, speed or functionality of the Service,
      7. introduce a virus, Trojan horse, worm, time bomb or other malware to the Service, or use any device, software, or routine to bypass any software or hardware that prohibits volume requests for information,
      8. violate, bypass or circumvent any security measure intended to limit or prevent access to CoinPaprika or the Service, or otherwise attempt to gain unauthorized access to CoinPaprika, any Content or any computer systems and networks connected to CoinPaprika, whether through hacking, password mining, unauthorized use of another person's password/credentials or any other means,
      9. restrict, inhibit or interfere with the use of CoinPaprika by any other user,
      10. introduce or otherwise distribute through CoinPaprika any computer program that damages, interferes with, intercepts, collects, releases or discloses any system, data or personal information of ours or any third party,
      11. make use of any of the Service Provider’s trademarks, service marks, trade names and logos or those of any third party displayed on the Website; and modify or remove any copyright or other proprietary notice in the Content,
      12. use the Content or the Services for or in connection with any activity that violates any law, statute, ordinance, or regulation and involves pursuing of any unlawful or illegal activity
   2. The use of electronic services may be related to a typical and commonly known risk regarding usage of computer equipment and the internet. That is why it is recommended to use security measures such as antivirus software or firewall which increase security and minimize such risk.

5. Conclusion of the agreement, commencement of the provision of services, the right of withdrawal

   1. Subject to provision of section 5.2. the agreement is concluded implicitly the moment the use of Services begins, that is, the moment the user logs into the Website. Provision of services commences at the same moment.
   2. In case of choosing a Plan other than Free, the agreement on providing Services within chosen Plan is concluded at the moment of payment of subscription fee.
   3. If you decide to select a Plan other than Free you agree that the provision of the Services begins immediately after confirmation of the payment. By doing so, you confirm that you are aware of losing right of withdrawal within 14-days period.
   4. Subject to provisions of section 5.3 the User being consumer according to rules of Polish law has the right to withdraw from the agreement within 14 days without giving any reason.
   5. The right of withdrawal will expire after 14 days from the day on you acquired the access to the Services.
   6. To exercise the right of withdrawal, you must inform Service Provider of the decision to withdraw from the agreement by an unequivocal statement (e.g. e-mail or a letter sent by post).
   7. To meet the withdrawal deadline, it is sufficient to send communication concerning exercise of the right of withdrawal before the withdrawal period has expired.

6. Plans and Payments

   1. You can subscribe to one of our Plans.
   2. Scope of Services provided by CoinPaprika depends on subscribed Plan.
   3. If you subscribe to a Plan other than Free you are obliged to pay a subscription fee.
   4. The billing cycle length is one month.
   5. Billing cycle starts on a day of payment and ends at 11:59 pm on a day in the next month corresponding to the date of the day preceding the billing cycle start date.
   6. You must provide one or more payment methods.
   7. You authorize us to charge any payment method provided by you in case your primary payment method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your Plan, we may suspend your access to the Services until we have successfully charged a valid payment method, or we may cancel your Plan and downgrade it to Plan Free. For some payment methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your payment method. Local tax charges may vary depending on the payment method used. Check with your payment method service provider for details.
   8. Your Plan starts on the day of payment. Your Plan expires on the last day of billing cycle in the following cases:
      1. on your demand – you can always cancel your Plans, in case of cancelation, Plan expires on a day of the end of the billing cycle,
      2. if we cancel your Plan due to non-payment of subscription fee.
   9. We can cancel your Plan immediately in case you breach Terms of Use.
   10. You can always change your Plan (upgrade or downgrade it). However, a change of plan comes into force on the first day of the subsequent billing cycle.
   11. In case of no change, cancellation or other unsubscribing of the Plan in the current billing cycle, your subscription renews automatically for the subsequent billing period.

7. Special provisions regarding Services

   1. The goal of the Service of access to the Content is to make it possible for Users to get acquainted with data regarding, among others, exchange rates of a number of cryptocurrencies and their changes in time as well as data on the Initial Coil Offerings (current and future). These data come from third party and are downloaded by the Service Provider from source websites.
   2. The Service Provider does not verify genuineness and correctness of the Content and does not guarantee its correctness, accuracy or validity.
   3. Data regarding exchange rates of cryptocurrencies are presented with delay in relation to the date of their publication by third party on a source website. The standard delay amounts to five minutes.
   4. The Service Provider does not guarantee continuous access to the Website and, thus, continuous access to the Content.
   5. The Service provider makes it possible for Users to send text messages to the Service Provider via CoinPaprika, including via CoinPaprika Request Form.
   6. The Service Provider is not obliged to reply to Users’ messages.
   7. The Service Provider is not obliged to reply to Users’ messages, unless Terms of Use or provisions of Polish law states otherwise.
   8. If you subscribed to our newsletter, we will send you emails regarding operation of CoinPaprika and the Service Provider, including trade information.

8. Service Provider’s liability

   1. Any liability of the Service Provider for possible damages that occurred on the part of the User in relation to the use of CoinPaprika is excluded to the biggest extent admissible by the Polish law.
   2. In particular, the Service Provider is not liable for damages related to:
      1. presence of force majeure,
      2. action or negligence of third party, for which the Service Provider is not responsible, especially damages resulting from untrue, inaccurate and invalid data,
      3. User’s decisions, including investment decisions made on the basis of the Content,
      4. errors of the User’s software,
      5. interruptions of access to CoinPaprika, partial or general,
      6. malfunctions of the User’s equipment,
      7. malfunctions on the part of provider of telecommunication services, including internet access service malfunction,
      8. use of data accumulated at CoinPaprika by Users.
   3. The limitation of the liability of the Service Provider does not apply to Users being consumers according to rules of Polish law.

9. Complaints

   1. If you believe there are or have been irregularities in terms of provision of Services,you can submit a complaint via email to the Service Provider’s address (specified in section 1.4. above) ). The Service Provider asks that this complaint includes (a) as detailed description of the irregularities as possible, (b) the date the irregularities occurred and the time of their duration.
   2. We will examine complaints within 30 days from submission. We will send a response via email.

10. Personal data, privacy

    1. We included information regarding processing of your personal data and data accumulated by the Service Provider in a separate document – Privacy Policy – which is available on the Service Provider’s website at www.coinpaprika.com/privacy-policy

11. Final provisions

    1. To the matters concerning this Agreement, provisions of the Polish law shall be applicable.
    2. Any disputes that may arise between the Service Provider and the User shall be settled by a common court of competent subject matter jurisdiction in Poznań (Poland), provided that it is not stated otherwise by the Polish regulations. This provision does not apply to Users being consumers according to rules of Polish law

    3. You have the right to download a printable version of the Terms of Use from www.coinpaprika/terms-of-use and save them on your own data storage device.

    4. The Terms of Use come into effect on 21.09.2022.
